ACCEPTANCE OF TERMS
By accessing and using the services provided by The Good Mood Club and Chelsea van Eeden, you agree to comply with and be bound by these Terms of Use.
- DEFINITIONS
- "Services": Refers to all services provided by The Good Mood Club and Chelsea van Eeden, including 1-on-1 online Pilates sessions, in-person Pilates sessions, virtual group classes, and on-demand content.
- "User": Refers to any individual who accesses or uses the Services.
- "Content": Refers to all materials provided through the Services, including videos, text, images, and other media.
- "Instructor": Refers to Chelsea van Eeden or any authorized Pilates instructor providing services on behalf of Chelsea van Eeden and The Good Mood Club.
- SERVICES OFFERED
- 1-on-1 Online Pilates Sessions
- In-person Pilates Sessions
- Virtual Group Classes
- On-Demand Content
- PAYMENT TERMS
- Payment Methods: Online payments through Stripe.
- Refund Policy: Subscriptions, Packages and Memberships are non-refundable and non-transferable.
- Package Validities:
- 5 Pack: Valid for 2 months.
- 10 Pack: Valid for 3 months.
- 15 Pack: Valid for 4 months.
- CANCELLATION POLICY
- For private 1-on-1 sessions, cancellations must be made via email, WhatsApp, or Google Calendar.
- Sessions canceled 24 hours or more before the start of the class are credited in full.
- Late cancellations (less than 23 hours before the start of the session) will be charged in full and may be credited on a case-by-case basis.
- Sessions/packages are non-refundable or transferable.
- For package extensions due to unforeseen circumstances, contact Chelsea van Eeden via email.
- USER RESPONSIBILITIES
- 1-on-1 Sessions:
- Members should be cleared by a medical professional before starting any exercise routine.
- Provide a medical history of current and past injuries, surgeries, and medication.
- Inform the Pilates Instructor of any changes in the ability to exercise before commencing a class/session.
- Written medical consent is required for rehabilitation sessions.
- The Pilates Practitioner may discontinue a session and request medical clearance from a Medical Doctor or Physiotherapist if deemed necessary.
- Online Live and On-Demand Classes:
- Ensure clearance from a medical professional before starting any exercise routine.
- Ensure the environment is clear of obstacles and use appropriate Pilates equipment (8mm+ thick Pilates mat).
- Classes are not a substitute for professional medical advice, diagnosis, or treatment.
- Participation in exercises is at your own risk.
- Exercising Pregnant / Prenatal & Postnatal:
- It is inadvisable to do On-Demand Pilates between weeks 8 to 14 of pregnancy and required to obtain clearance from a health practitioner before starting Pilates during pregnancy. It is recommended to wait 6 weeks after birth and obtain clearance from a health practitioner before resuming exercise post-natal.
- The Good Mood Club's On-Demand Pilates routines are not specifically tailored for pre or post-natal Pilates or specific conditions. While Pilates exercises are generally safe and recommended during pregnancy, it is prudent to consult with a physician before starting a new exercise program and follow their safety recommendations.
- INTELLECTUAL PROPERTY & PRIVACY POLICY

Check the privacy policies and terms of service of other sites before engaging with them.
- Use of Personal Information:
Your private information will be used for personal and marketing communication with you directly and identifying you to authorized Pilates instructors and health professionals, when required and with your consent.
- Content Usage:
No company content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way without written permission.
- Electronic Communication:
By registering, you consent to receive notices electronically via email.
- Submissions:
Comments or suggestions submitted to the company become the sole property of the company.
- Data Security:
Efforts will be made to restrict unauthorized access to data and files, but use of the site is at your own risk.
- Disclosure of Information:
The company will not intentionally disclose any personally identifying information unless required by law or to enforce these terms.
- DISCLAIMERS AND LIMITATION OF LIABILITY
The services provided by The Good Mood Club and Chelsea van Eeden are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, The Good Mood Club and Chelsea van Eeden disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. The Good Mood Club and Chelsea van Eeden do not warrant that the services will be uninterrupted or error-free. In no event shall The Good Mood Club and Chelsea van Eeden be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of or inability to use the services.
- INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Good Mood Club, Chelsea van Eeden, and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the services, any user content you provide, your violation of these Terms of Use, or your violation of any rights of another.
- GOVERNING LAW AND DISPUTE RESOLUTION
These Terms of Use shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or relating to these terms or the services shall be resolved through binding arbitration in South Africa, except that either party may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
- MODIFICATION OF TERMS
The Good Mood Club and Chelsea van Eeden reserve the right to modify these Terms of Use at any time. Continued use of the services constitutes acceptance of any changes.
- FORCE MAJEURE
The Good Mood Club and Chelsea van Eeden shall not be liable for any failure to perform its obligations hereunder where the failure results from any cause beyond The Good Mood Club and Chelsea van Eeden's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
